Can I write a will by myself?
This is quite possible but the intervention of a professional is always advised to ensure that its form and content comply with local regulations and especially that of the law applicable to your estate to avoid any litigation between the heirs.
In addition, for the registration of a will at the DIFC you must call upon a lawyer authorized by the DIFC (“Wills Draftsmen”).
In what language can the will be written?
The will can be drawn up in English, Arabic, or English and Arabic. French is not accepted, but a certified French translation can be sent to you if you wish.
What assets can be included in this will?
All assets located in the United Arab Emirates can be included in your will registered with the DIFC: real estate, bank account, car, boat, table, etc.
Animals and plants cannot be included.
Can the will take into account assets located in a different Emirates than that of Dubai?
Yes, it is now possible to include assets located in the Emirates other than Dubai and Ras-Al-Khaimah in the DIFC will.
What about assets located outside the Emirates?
Several cases are possible:
- Real estate assets: it is usually the law of the country where these properties are located that is applicable in the event of succession (to be validated country by country).
- Non-real estate assets:
- If you are a resident of the Emirates: this will be the testament of the Emirates which will apply unless otherwise local regulations.
If you are not or no longer a resident of the Emirates: the law of your country of residence will apply.
